In order to fully implement the Animal Veterinary Epidemic Prevention Law, the Measures for the Administration of Animal Diagnostic and Therapeutic Institutions, the Measures for the Administration of Practicing Veterinary Medicines, the Measures for the Administration of Veterinary Prescription Drugs and Non-Prescription Drugs, and the Opinions of the Ministry of Agriculture on Promoting the Construction of the Practice of Veterinary Medicine Yifa [2011] No. 15), to further regulate animal diagnosis and treatment activities and veterinary practices, improve the level of animal diagnosis and treatment institutions and practicing veterinary services, after research, our Ministry is scheduled to be nationwide from June 1, 2014 to August 31, 2014 Organize a three-month centralized cleaning and rectification of animal diagnosis and treatment institutions. The relevant matters are notified as follows.
First, the target task
Through clean-up and rectification, severely crack down on illegal practices of animal diagnosis and treatment institutions and licensed veterinarians, ban illegal animal diagnosis and treatment institutions, regulate the management of animal diagnosis and treatment institutions, improve the order of the animal diagnosis and treatment market, and promote the healthy development of the animal diagnosis and treatment industry.
Second, the scope of cleaning
The local veterinary authorities at all levels shall organize the comprehensive cleaning and rectification of animal diagnosis and treatment institutions in their respective administrative areas, with a focus on urban pet diagnosis and treatment institutions.
Third,Clean up the content
The local veterinary authorities at all levels shall, on the basis of a thorough understanding of the animal diagnosis and treatment institutions in their respective administrative areas, focus on the following matters:
(I) Establishment of animal diagnosis and treatment institutions
1. Whether to obtain the Animal Diagnosis and Treatment Permit and whether there is any situation in which animal diagnosis and treatment is performed without permission;
2. Whether there is any forgery, alteration, transfer, renting, borrowing, and transfer, lease, lending of animal diagnosis and treatment licenses;
3. Whether the animal diagnosis and treatment institution changes the place of business and the scope of diagnosis and treatment activities, whether to re-perform the permit procedures in accordance with the law, and apply for the issue of an animal diagnosis and treatment license;
4. Whether the number of practicing veterinarians in animal diagnosis and treatment institutions meets the requirements of the “Administrative Measures for Animal Diagnosis and Treatment Institutions”.
(II) Employment of animal diagnosis and treatment institutions
1. Whether to publicize the "Animal Diagnosis and Treatment Permit", the veterinary surgeon's practice certificate, and the assistant veterinary surgeon's practice certificate in a prominent position in the animal diagnosis and treatment institution;
2. Whether to carry out animal diagnosis and treatment activities within the scope of the approved diagnosis and treatment activities;
3. Whether to report the annual animal diagnosis and treatment activities to the issuing authority in accordance with regulations;
4. Are the sick and dead animals, animal pathological tissues and medical wastes treated in accordance with regulations, and whether the treatment wastewater is harmlessly treated?
(3) Practice of practicing veterinarians
1. Have you obtained the qualifications of a licensed veterinary surgeon or a licensed assistant veterinary surgeon, have you registered or filed a veterinary surgeon's practice certificate or an assistant veterinary surgeon's practice certificate according to law?
2. Whether there are forgeries, alterations, transfers, leases, borrowings, and transfers, leases, or lending of veterinary surgeon licenses or assistant veterinary surgeon licenses;
3. Whether to engage in animal diagnosis and treatment activities beyond the scope of practice approved by the registration authority;
4. Whether to use standardized medical records, prescriptions and keep according to regulations;
5. There are no cases of prescribing, prescribing medicines, and issuing supporting documents without diagnosis and treatment;
6. Whether to report annual practice activities to the registration authority as required;
7. Whether to use veterinary drugs and veterinary equipment that do not comply with national regulations.
24. Rectification measures
The local veterinary authorities and animal health supervision agencies at all levels shall take the following measures to deal with various illegal acts in accordance with the law on the basis of comprehensive cleanup:
(I) Order to stop working activities
1. Animal diagnosis and treatment institutions engaging in animal diagnosis and treatment activities without obtaining animal diagnosis and treatment permits, and those who have not registered in animal diagnosis and treatment activities shall be ordered to suspend business, confiscate illegal gains and be fined;
2. Forgeries, alterations, transfers, leases, borrowed animal diagnosis and treatment licenses, veterinary surgeon licenses or assistant veterinary surgeon licenses shall be collected by the animal health supervision agency in accordance with the law, ordered to suspend business, confiscation of illegal gains and fined.
(2) Ordering rectification within a time limit
If an animal diagnosis and treatment permit has been obtained, but the animal diagnosis and treatment permit conditions are no longer met, the animal health supervision agency will issue a warning and order correction within a time limit. If the prescribed conditions are still not met within the time limit, the original license issuing authority will withdraw and revoke its animal diagnosis and treatment. license.
(C) cancellation of related certificates
Under the following circumstances, the original certificate issuing authority shall cancel the relevant certificate:
1. Transfer, lease, loan of animal diagnosis and treatment license, veterinary doctor's license or assistant veterinary doctor's license;
2. Engage in animal diagnosis and treatment activities beyond the scope of diagnosis and treatment activities approved by the animal diagnosis and treatment license, and change the place of employment, the scope of the diagnosis and treatment activities without re-applying the animal diagnosis and treatment license, the circumstances are serious; engage in animal diagnosis and treatment activities beyond the scope of practice approved by the registration authority, If the changed animal diagnosis and treatment institution is re-registered or filed, the circumstances are serious;
3. Animal diagnosis and treatment institutions have been out of business for more than two consecutive years, or have not reported animal diagnosis and treatment activities to the issuing authority for two consecutive years, and refused to correct them; a practicing veterinarian has suspended veterinary practice for two years, or has not practiced for two consecutive years The activities are reported to the registration authority and refused to be corrected.
(4) Other
Animal diagnosis and treatment institutions that use veterinary drugs illegally or dispose of waste illegally in the diagnosis and treatment activities shall be punished in accordance with the relevant laws and administrative regulations.
V. Relevant requirements
(1) Strengthen organizational leadership. Provincial (autonomous regions, municipalities directly under the Central Government) veterinary departments shall effectively strengthen organizational leadership and formulate a sound work plan for cleanup and rectification. It is necessary to conduct special trainings for law enforcement personnel, unify thinking and policy boundaries, clarify law enforcement procedures, improve the level of law enforcement, and ensure that orderly and effective work is carried out. It is necessary to conscientiously summarize the work of cleaning up and rectifying, analyze the existing problems, and put forward opinions and suggestions for improving related work.
(2) Launch extensive publicity. All localities should make full use of the Internet, newspapers, periodicals, clear papers, and notices to carry out publicity, explanation, and notification of laws, regulations, and related policies and regulations to the society, especially animal diagnosis and treatment institutions and veterinary practitioners. Exposing typical cases of illegal animal diagnosis and treatment activities and unlicensed medical practice investigated and dealt with in recent years, the animal diagnosis and treatment permits and veterinary personnel certificates should be disclosed in a timely manner, accept social supervision, and enhance the law-abiding consciousness of managing relatives.
(3) Promote information management. The registration or filing of licensed veterinarians must be carried out through the national veterinary team information management system, so that the management information of licensed veterinarians in various places can be effectively interconnected. At the same time, information on the management, continuing education, illegal behavior, and integrity records of practicing veterinarians should be entered into the system in a timely manner to continuously improve the information management level of the veterinary team.
(4) Strengthen supervision and management. All localities shall strengthen the management of animal diagnosis and treatment institutions, formulate and improve relevant management methods and construction standards, strictly enforce animal diagnosis and treatment and the registration and approval of licensed veterinarians, and strengthen daily supervision and special inspections.
The competent department of veterinary medicine of each province (autonomous region, municipality directly under the Central Government) is requested to report the situation of rectification and related forms (see attachment) to the Veterinary Bureau of our Ministry before September 15.
